3. Service Nature & No Guarantee Clause

 

Digital marketing and lead generation services are performance-influenced services. While we use commercially reasonable efforts to deliver targeted and relevant leads:

 

  1. We do not guarantee conversions, sales, revenue, or business outcomes.

  2. Lead performance depends on multiple external factors including pricing, response time, follow-up process, service quality, and market conditions.

  3. We are not responsible for a client’s inability to convert leads.

4. Payment Terms

 

  1. All payments must be made in advance unless otherwise agreed in writing.

  2. Fees once paid are non-refundable.

  3. Subscription renewals may occur as per agreed plan terms.

  4. Late payments may result in suspension or termination of services.

5. Cancellation & Refund Policy

 

  1. As our services are digital and subscription-based:

No refunds will be provided once payment is processed.

Once services are activated, campaigns launched, or leads delivered, the transaction is considered complete.

  1. Mid-cycle cancellations do not qualify for refunds.
  2. Subscription cancellations must follow notice terms mentioned in the agreement.

Clients are advised to review proposal documents carefully before making payment.

6. Lead Delivery Terms

 

  1. Leads are generated based on selected categories, geography, and targeting criteria.

  2. We strive to provide relevant and verified leads.

  3. We do not guarantee contactability, intent level, or conversion.

  4. Concerns regarding lead quality must be reported within the timeframe specified in the service agreement (if applicable).

7. Client Responsibilities

 

The client agrees to:

  1. Provide accurate business information

  2. Respond to leads in a timely manner

  3. Maintain ethical business practices

  4. Avoid misusing or reselling leads

  5. Comply with applicable laws and regulations

Failure to comply may result in service suspension without refund.

8. Intellectual Property

 

All content, designs, marketing materials, reports, and strategies developed by us remain our intellectual property unless otherwise agreed in writing.

Clients may not copy, resell, distribute, or reproduce proprietary systems without authorization.

9. Limitation of Liability

 

To the maximum extent permitted by law:

  1. Our liability shall not exceed the amount paid for the service.

  2. We are not liable for indirect, incidental, or consequential losses including loss of revenue, profit, or business opportunities.

  3. We are not responsible for third-party platform outages (Google, Meta, hosting providers, etc.).

10. Termination of Services

 

We reserve the right to suspend or terminate services if:

  1. Payments are overdue

  2. Client violates these Terms

  3. Fraudulent, abusive, or unethical conduct is identified

Termination does not entitle the client to a refund.

11. Force Majeure

 

We shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

  1. Government restrictions
  2. Internet outages
  3. Platform algorithm changes
  4. Natural disasters

12. Governing Law & Jurisdiction

 

These Terms shall be governed by and construed in accordance with the laws of India.

 

Any disputes shall be subject to the exclusive jurisdiction of courts located in Bangalore, Karnataka.

13. Amendments

 

We reserve the right to modify these Terms at any time. Updated versions will be published on our website.

 

Continued use of our services constitutes acceptance of updated Terms.
